Terms of Service

These terms are the agreement between you and Playdate for using the Playdate app, website, iOS share extension and App Clip (together, “Playdate” or “the service”). By using Playdate you agree to them. If you do not agree, do not use Playdate.

What Playdate does

Playdate takes a link to a song, album, artist or playlist on one music streaming service, finds the same music on other services, and gives you one link that opens in whichever service the person you send it to uses. Matching is done automatically against the services’ public catalogues; the app tells you whether a match is exact, a different version, or not found. Playdate does not host, stream or copy any music. Playback always happens in Spotify, Apple Music or Deezer under your agreement with them.

Who can use it

You must be at least 13 years old (or the minimum age for using online services where you live, if higher) and able to enter into this agreement. If you use Playdate on behalf of an organisation, you confirm you may bind it to these terms.

Your streaming service accounts

Connecting Spotify or Apple Music is optional and needed only for playlists. When you connect one you authorise Playdate to act on your account only to the extent shown on the service’s permission screen and only to do what you ask in the app. You are responsible for that account, for keeping your access to it, and for complying with the service’s own terms (Spotify’s Terms of Use, Apple Media Services Terms and Conditions, Deezer’s Terms of Use). Some features depend on those services: they may need a paid subscription, may be unavailable in your country, and may stop working if a service changes or withdraws its API. Playdate is not affiliated with, endorsed by or sponsored by Spotify, Apple or Deezer; their names and logos belong to them.

Links you create

A Playdate link is public: anyone who has it can open it and see the music it points to, and it stays available so the people you send it to can keep using it. When you convert a playlist, you are asking us to store its public details and, for Spotify, to publish a copy of it on Playdate’s own Spotify account that anyone with the link can open. Only share what you are entitled to share and are comfortable being seen by anyone with the link. You can ask us to delete a link at any time (see Contact).

You keep whatever rights you have in the playlists you make. You give us a non-exclusive, worldwide, royalty-free licence to store, copy, display and transmit the playlist details and the links you create to the extent needed to operate the service, including creating the hosted copy on Spotify.

Acceptable use

Do not use Playdate to:

We may remove a link, disable a hosted playlist, or block a device or identifier that we reasonably believe breaks these terms, and we may do so without notice where needed to protect the service or others.

Playdate’s content

The Playdate name, mark, app, website, design and code belong to Playdate or its licensors and are protected by copyright and trademark law. We give you a personal, non-transferable, revocable licence to use the app and website as intended. Music, artwork and catalogue information shown in Playdate belong to the streaming services and rights holders and are displayed under the services’ API terms.

The iOS and Android apps are licensed, not sold, to you. Apple and Google are not parties to these terms and have no obligation to provide support or maintenance for the app; the standard terms of the App Store and Google Play also apply to your download.

Free service, changes and ending it

Playdate is free. We may change, suspend or discontinue any part of the service at any time, with or without notice, and we may stop hosting a link or playlist. If we introduce paid features we will say so clearly before you use them. You can stop using Playdate at any time by deleting the app; you can ask us to delete your links and stored data (see Contact).

No warranty

Playdate is provided “as is” and “as available”. Music matching is automatic and can be wrong: a link may open a different recording, a playlist may come across incomplete, and a service may be unavailable. To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement and uninterrupted or error-free operation.

Limitation of liability

To the fullest extent the law allows, Playdate will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of or inability to use Playdate, even if advised of the possibility. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim (which for a free service is zero) and US $50. Some jurisdictions do not allow some of these limits, so they may not fully apply to you; nothing here limits liability that cannot be limited by law.

Indemnity

You agree to defend and hold Playdate harmless from claims, losses and expenses (including reasonable legal fees) arising from content you share through Playdate or your breach of these terms or of a streaming service’s terms.

Disputes and governing law

If you have a problem, email us first and we will try to sort it out informally. These terms and any dispute about them or the service are governed by the laws of the place where Playdate is established, without regard to conflict-of-law rules, and the courts there have exclusive jurisdiction, except that if you are a consumer you keep any protection and right to bring a claim in your own country that the law gives you and that cannot be waived by agreement.

Changes to these terms

We may update these terms. We will change the date at the top and, for a material change, tell you in the app or on the website before it takes effect. Using Playdate after that means you accept the new terms. If any part of these terms is found unenforceable, the rest still applies. These terms and the Privacy Policy are the whole agreement between you and us about Playdate.
